1. Overview
This website (www.carterfarrago.com) is operated by Connext Five Three LLP, a limited liability partnership registered in Surat, Gujarat, India, trading as CARTER FARRAGO ("Carter Farrago", "we", "us", "our").
These Terms govern your use of the website, including browsing, creating an account and purchasing products. Using the website means you must follow the rules of use in Section 4. A purchase contract is formed only when you place an order after actively agreeing to these Terms by ticking the unticked acceptance box at checkout. We never pre-tick it.
These Terms are an electronic record under the Information Technology Act, 2000 and need no physical or digital signature. The following form part of your purchase contract: our Privacy Policy, Shipping Policy, Cancellation, Return & Refund Policy, Service & Warranty Policy, and the product page for what you buy.
Your statutory rights. Nothing in these Terms or those policies limits your rights under the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, the Sale of Goods Act, 1930 or other applicable law. If these Terms and a policy conflict, the term more favourable to you applies.
2. Eligibility
You may use the website and place an order only if you are at least eighteen years old, legally competent to contract, not prohibited by law, and provide accurate information. If you order for a company or other entity, you confirm you are authorised to bind it. We take steps to confirm age at account creation and checkout.

4. Use of the Website
You must not:
- use the website for any unlawful or fraudulent purpose, or give false, misleading or impersonated information;
- interfere with the operation, security or performance of the website, or circumvent security, access-control or purchase-limit measures;
- scrape, crawl or extract website data by automated means without written permission;
- reproduce, distribute or commercially exploit website content, or use our name, trademarks, images or designs in a misleading manner, without written permission;
- submit abusive, defamatory or unlawful material;
- place fraudulent or bad-faith orders, or misuse discount codes, referral arrangements or the EMI facility.
We may restrict, suspend or terminate access where we reasonably believe these rules have been broken, and we will tell you why. Purchase limits, where they apply, are shown on the product page before you order.
5. Product Information
We take reasonable care to ensure that product descriptions, specifications, dimensions, movement information and photographs displayed on the website are accurate. The product page at the time of your order forms part of your purchase terms. Product pages show the declarations required by law, including price, country of origin, manufacturer or importer details, and dispatch timeline. However:
- colours may appear differently depending on screen settings and lighting;
- dimensions and weights may be subject to minor manufacturing tolerances; and
- natural materials may display minor variation in grain, tone or texture.
A minor difference that does not materially alter the product's identity, quality or function will not by itself constitute a defect. A difference from what we advertised or agreed that does matter is a defect or non-conformity, and Section 10 applies.
6. Watch Characteristics
Mechanical watches have operating characteristics specific to their movement. The following are not treated as manufacturing defects where they fall within the specification published on the product page: movement accuracy withinthe tolerance stated on the relevant product page; variationcaused by temperature, position, activity, power reserve or magnetism; normal movement or rotor sound; the need for periodic winding, setting, regulation or servicing; and gradual wear of straps, bracelets, clasps and finishes. A watch that performs outside the published tolerance is treated as defective. This Section does not limit your rights under Section 10.
7. Prices and Taxes
- Prices are in Indian Rupees and include applicable GST unless stated otherwise. Exports are zero-rated for GST, so Indian GST is not charged on international orders. Duties and taxes of the destination country are payable by the recipient (see Shipping Policy).
- Before you pay, we show the total price as a single figure with a breakup of every charge (price, tax, delivery, handling and any fee).
- For international orders, any currency conversion is performed by the payment provider or card issuer.
- Prices and availability may change before we accept an order. A price change never affects an order we have accepted. If a price was shown in obvious technical or clerical error, we will tell you before we accept the order. You may then choose to proceed at the correct price or cancel for a full refund.
8. Orders and Payment
- Your order is an offer to buy. An automated message acknowledging it is not acceptance. We accept your order when we send an "Order Accepted" confirmation, after payment has been verified, ordinarily within 2 business days. If we do not accept your order, we refund the full amount within 5 business days.
- All orders are prepaid. Cash on Delivery is not offered. Payment methods are shown at checkout, with their security details, any fee, how to cancel recurring payments (where applicable), chargeback options and the payment provider's contact details.
- We may refuse, hold or cancel an order before dispatch where payment cannot be verified, the product is unavailable, the address is incomplete or unserviceable, the order appears fraudulent or high-risk, or fulfilment would breach law or courier restrictions. We tell you why and refund the amount paid in full, with no deduction, within 5 business days.
9. Shipping and Delivery
Shipping and delivery are governed by our Shipping Policy: dispatch and delivery schedules (stated on the product page and in your order confirmation), domestic and international delivery, customs duties, and risk of loss. In summary, we ship within India and, through DHL Express, to the countries listed at checkout. Risk stays with us only until delivery. Duties and import taxes on international orders are payable by the recipient and shown before you pay.
10. Cancellations, Returns and Refunds
Our Cancellation, Return & Refund Policy applies. In summary:
- You may cancel at any time before dispatch, with a full refund and no fee (personalised items may be cancelled only until personalisation begins, as shown before you pay).
- If a product is defective, damaged in transit, not as ordered or described, or delivered later than the stated schedule (other than force majeure), you are entitled to the remedies in that Policy, including replacement or refund at your choice and free return pickup.
- We do not accept returns for change of mind, size, fit or preference where the product is as described and not defective. We publish detailed specifications so you can decide before ordering.
Refunds go to the original payment method and are initiated within 5 business days of approval.
11. Warranty and Servicing
Carter Farrago products carry the warranty stated in our Service & Warranty Policy. That warranty is in addition to, and does not replace, your statutory rights and the remedies in Section 10. Warranty coverage, exclusions and claim procedures are set out in that Policy.
12. Customer Accounts
Where accounts are offered, you are responsible for keeping your credentials confidential and for activity under your account, and you must tell us promptly of suspected unauthorised access. We protect account data as described in our Privacy Policy.
13. Communications
- Service messages. We will use your phone number and email to send order confirmations, payment, delivery, return, refund, warranty and security messages needed to carry out your order or request. This does not need a separate consent box.
- Promotional messages (launches, offers, restocks, campaigns) are sent only if you opt in separately through an unticked choice at sign-up or checkout, and are sent in line with TRAI regulations, including the Telecom Commercial Communications Customer Preference Regulations. Declining does not affect your order or any warranty benefit.
- You can opt out of promotional messages at any time by replying STOP, using the unsubscribe link, or writing to support@carterfarrago.com. Opting out does not stop service messages.
14. Reviews and User-Submitted Content
If you submit a review, photograph or other content, you confirm you own it or have permission to submit it. You grant Carter Farrago a non-exclusive, royalty-free licence to store, reproduce and display it to operate and promote the website. You must not submit content that is false, defamatory, obscene, invasive of privacy, infringing, harmful to children, impersonating another person, or otherwise unlawful, or that contains malicious software.
15. Intellectual Property
The Carter Farrago name, logo, product and packaging designs, movement designs, photographs and all website content are owned by or licensed to Connext Five Three LLP and are protected under applicable intellectual-property law. Access to the website does not transfer any intellectual-property right to you. You may not reproduce, distribute, publish or commercially exploit protected material without our prior written permission.
16. Privacy
We collect, use, share and protect your personal data as described in our Privacy Policy, which forms part of these Terms. We ask for your consent separately for each purpose that needs it, and you can withdraw it at any time.
17. Limitation of Liability
Nothing in these Terms excludes or limits liability that the law does not allow us to exclude or limit. That includes liability for fraud, wilful misconduct, death or personal injury, product liability under the Consumer Protection Act, 2019, your rights and remedies for defective goods and deficient services, and any compensation a Consumer Commission may award.
Subject to that, and to the extent permitted by law, we are not liable for loss that was not reasonably foreseeable when you placed your order.
18. Events Outside Our Control
We are not responsible for delay or failure caused by a genuine force majeure event: an event beyond our reasonable control that reasonable precautions could not have prevented, such as natural disaster, war or hostilities, epidemic, government restriction or order, or general strike or civil unrest. Our own technical failures, production or supply-chain delay, and the performance of our logistics and payment partners are not force majeure. Section 13 of the Shipping Policy applies, including your right to cancel for a full refund in a long delay.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Subject to any mandatory consumer forum or statutory remedy available under applicable law, courts having jurisdiction in Surat, Gujarat shall have exclusive jurisdiction over disputes arising from these Terms.
20. Changes to These Terms
We may update these Terms from time to time. The revised Terms will be posted on the website with an updated “Last Updated” date. The version in effect when an order is placed will ordinarily govern that order.
21. General Provisions
Severability
If any provision of these Terms is held unlawful or unenforceable, the remaining provisions will continue in effect.
No Waiver
A delay or failure by Carter Farrago to enforce a provision does not waive the right to enforce it later.
Assignment
You may not transfer your rights or obligations under an order without our written consent. Carter Farrago may transfer its rights or obligations as part of a genuine merger, restructuring or sale of its business.
Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, Cancellation, Return & Refund Policy, Service & Warranty Policy and any product-specific terms, constitute the entire agreement between you and Carter Farrago concerning use of the website and purchases made through it.
